Terms of service

These Terms of Service govern use of Estimate Followup, Estimate Followup Pro, the public website, member dashboard, calculators, scripts, scheduling tools, imports, exports, templates, files, and related support. By purchasing, creating an account, accessing the dashboard, importing lead data, or using the site, the customer agrees to these Terms.

Product description

Estimate Followup Pro is a self-serve contractor lead recovery workspace. It may include a dashboard, lead tracker, lead rating algorithm, follow-up queue, SMS and email draft builder, scheduling calendar, import/export tools, reminders, and business templates. Features may change, improve, be removed, or be replaced as the product develops.

The product helps organize follow-up work. It does not replace a CRM, phone system, email provider, SMS provider, attorney, accountant, marketing agency, call center, estimator, dispatcher, or business consultant.

Eligibility and business use

The service is intended for business users who are at least 18 years old. A person using the service on behalf of a company represents that they have authority to bind that company to these Terms. The customer is responsible for all activity under its account and for ensuring all team members follow these Terms.

Accounts and access

Customers must provide accurate account information and keep login credentials secure. Shared logins, weak passwords, unauthorized access, and failure to remove former employees may create business risk. Estimate Followup is not responsible for losses caused by a customer's failure to control account access, protect devices, secure email accounts, or manage staff permissions.

Access to paid features may depend on subscription status, payment status, authentication provider availability, browser storage, database availability, and third-party services. We may suspend or restrict access for unpaid invoices, suspected fraud, abuse, security risk, violation of these Terms, chargebacks, or legal requests.

Subscriptions and billing

Paid access is sold as a recurring monthly subscription unless another written offer says otherwise. The subscription renews automatically until cancelled. Prices, plan limits, included features, and add-ons may change for future billing periods, subject to applicable law and any notice required by the payment provider.

Payments, receipts, taxes, failed payment retries, card updates, customer portal access, and subscription status may be handled by Stripe or another checkout provider. The customer is responsible for keeping billing information current and for any taxes, fees, or charges associated with the subscription.

Customer data and permissions

The customer owns and is responsible for the lead lists, contact data, notes, estimates, appointment information, and other business records they add to the service. The customer represents that it has all rights, permissions, notices, and legal bases needed to upload, store, process, export, text, email, call, or otherwise use that information.

The customer must not upload information that is illegal, highly sensitive, confidential beyond the customer's authority, or unnecessary for contractor follow-up. This includes Social Security numbers, bank account numbers, medical records, government IDs, private claim files, passwords, or data collected without required permission.

Messaging and communication compliance

The service may help draft SMS, email, phone, and follow-up language. The customer is solely responsible for compliance with all laws, industry rules, and platform policies that apply to contacting leads, including rules related to consent, opt-outs, Do Not Call lists, telemarketing, texting, email marketing, consumer protection, privacy, advertising claims, and recordkeeping.

Before sending any message, the customer must confirm that the message is accurate, truthful, properly consented, not misleading, not harassing, and appropriate for the recipient. The customer must honor unsubscribe, STOP, opt-out, do-not-contact, and similar requests immediately where required.

Scripts, Lead Rating, and business decisions

Scripts, Lead Ratings, recommendations, calculators, revenue examples, and dashboard priorities are informational tools. They are based on user-entered data, general assumptions, and product logic. They may be incomplete, outdated, wrong, or unsuitable for a specific business, market, customer, job type, or legal requirement.

The customer must use independent judgment before relying on any output. Estimate Followup does not guarantee that a script will be compliant, that a lead rating is correct, that a lead will close, that a customer will respond, or that a particular follow-up action is the best business decision.

No professional advice

Estimate Followup does not provide legal, financial, tax, accounting, insurance, employment, construction, licensing, advertising, or compliance advice. Customers should consult qualified professionals for advice about laws, contracts, licensing, taxes, insurance, hiring, marketing compliance, messaging compliance, and business operations.

License to use the product

During an active paid subscription, Estimate Followup grants the customer a limited, non-exclusive, non-transferable, revocable license to use the dashboard, scripts, calculators, templates, and member materials for the customer's internal business operations. This license ends when access is terminated or the subscription is cancelled, except for customer data the customer has exported and materials that applicable law allows the customer to retain.

Restrictions

Third-party services

The product may rely on Stripe, Supabase, Vercel, email providers, browser vendors, analytics providers, calendar apps, CRM tools, SMS providers, and other third-party services. Estimate Followup does not control those providers and is not responsible for their downtime, errors, pricing, policy changes, data handling, app-link behavior, rejected emails, blocked texts, deliverability, or account restrictions.

No revenue guarantee

Estimate Followup does not guarantee income, profit, lead volume, booked jobs, quote acceptance, reviews, conversion rates, customer responses, search ranking, advertising performance, or any business result. Results depend on many factors outside our control, including lead quality, timing, local market, competition, price, workmanship, reputation, licensing, staff execution, responsiveness, and customer demand.

Availability and changes

We aim to keep the product useful and available, but we do not guarantee uninterrupted or error-free access. The service may be unavailable due to maintenance, provider outages, internet issues, browser behavior, payment problems, security incidents, or product changes. We may modify, suspend, or discontinue features at any time, subject to applicable law.

Warranty disclaimer

The service and all materials are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent allowed by law, Estimate Followup disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, compatibility, and error-free operation.

Limitation of liability

To the fullest extent allowed by law, Estimate Followup will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, including lost revenue, lost leads, lost goodwill, lost data, business interruption, inaccurate outputs, failed messages, missed follow-ups, customer disputes, compliance violations, or third-party provider failures.

To the fullest extent allowed by law, the total liability of Estimate Followup for any claim related to the service will not exceed the amount paid by the customer for the service in the three months before the event giving rise to the claim, or $100 if no amount was paid.

Indemnification

The customer agrees to defend, indemnify, and hold Estimate Followup harmless from claims, losses, damages, fines, penalties, costs, and expenses arising from the customer's use of the service, uploaded data, messaging practices, failure to obtain consent, violation of law, violation of these Terms, account misuse, employee access issues, or disputes with the customer's leads, customers, vendors, or employees.

Termination

The customer may stop using the service or cancel the subscription according to the Refund and Cancellation Policy. We may suspend or terminate access if the customer violates these Terms, fails to pay, creates security risk, abuses support, misuses the product, causes legal exposure, or if continued service is not commercially or technically practical.

Changes to these Terms

We may update these Terms as the product or legal requirements change. Continued use of the service after updated Terms are posted means the customer accepts the updated Terms to the extent permitted by law.
